i agree, this is just like the xiao long nu story, having sex with someone without knowing. That is a story, in real life, it is almost impossible. Plus the fact that the woman thought whom she had had sex with was her husband. Which woman would mistake others for her husband? Why did she not open her eyes and see his face? This is totally nonsense IMO.Originally posted by SmallPanda:Errrrr..........this is not rape.
It sounds more like the wife was committing adultery and used rape as an irrational excuse to get away with a crime.
Adultery is very serious in Muslim countries you see. I've read a lot of incidents identical to this.
Don't be surprised to see a follow up story where this women is sentenced to death by stoning under Sharia law or something.
But this happened in Malaysia so probably not.
It is rape in the Singapore Penal code at least.Originally posted by T E M P O:If in any case the woman really did not know, and had sex with another man and stuff, still, this is not rape. Rape's when one is forced to have sex with, or unwilling sex, but this, like the woman had said, willingly. This is not rape as both parties are willing.
PS: Pardon for any mistakes, not raelly familiar with the law here.
375. A man is said to commit “rape” who, except in the case hereinafter excepted, has sexual intercourse with a woman under circumstances falling under any of the 5 following descriptions:
(d) with her consent, when the man knows that he is not her husband, and her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married or to whom she would consent;
Wow, Singapore laws is quite nonsensical.Originally posted by Icemoon:For those interested, under our penal code:

The reason why those silly anti oral or anti gay laws are not enforced is 'cos no-one complains and the police will not pry into your bedroom affairs.Originally posted by SmallPanda:Wow, Singapore laws is quite nonsensical.
But I wonder if this is just one of those silly laws where it is in the books but no lawyer or judge actually follows it.
Kinda like those silly anti oral sex laws or anti gay laws where people are never prosecuted under.
