I have a question and hope can get help here, thanks in advance.
I'm Singaporean with 1 daughter and just file for divorced in Malaysia last year.
Court order in Malaysia didn't mentioned about our HDB property in Singapore and now I'm having problem transfer my ex hubby shared to my name.
Can I do a court order in Singapore for hdb transfer purpose?
Called few law firm in Singapore, some said yes and some said no. I'm really confuse about this.
Anyone walked thru this? what exactly the procedure?
Please help, thank you very much.
Wow another gold digger trying to fleece.

Wow another Malaysian gold digger trying to fleece. Get a life and support yourself instead of financially incapacitating your ex-husband. And keep the moans of how bad he was and how he cheated to yourself. You had an equal hand in what ever happened.
If you are not able to help or advise, please stay away. thank you.
Ignore that bio hawk he is a forum troll. Too stupid for his own good.
I recommend you check with hdb directly. Make an appointment and go talk to an officer at their office.
Get it done soon, the longer you drag, the more complicated it gets.
Hello
It appears that you are a Singapore Citizen married to a Malaysian.
You file for divorce last year from your husband.
You mention Malaysian Court Order. What order was it ?
Is it the “decree nisi”.
Your lawyer ? Your lawyer should be following up with you on it.
Is it a Shariah Court ?
Regards.
thanks jojobeach..
hi, i dont have my own lawyer there, only using his lawyer and not Shariah court. I just wish can settle this asap because he already have new family. I wanted to start my new life with my daughter too.

Yes follow the valuable feminist ignorasmus advice and walk into HDB: 'Sir,me divorce, want my husband HDB,give me'. Thats all you need. And they will give you the keys for the house.
Have fun

Boy u really need to go out of your room more and find out how the world works out there.
Hdb will tell her what she needs to prepare so she can make the transfer.
Whats up with your hatred with women. Did your mother abandoned you when you were a baby ?

Yes. It is important to ensure your daughter is well taken care of. And to move on.
Find out as much as you can and take the necessary steps to resolve it.
Good luck and be strong.

You are too stupid to understand,I am not trying to explain anymore.God bless.
You mentioned that you are “using your husband’s lawyer”
It seems like you are not contesting the divorce.
You have property and children. Yet you are not contesting.
It simply means you agree with what is proposed by your husband’s lawyer.
Was there any mediation ?
There should be some mediation done. Else you will not imply that you are “using your husband’s lawyer”.
I guess you have forgotten about it.
If there was some mediation, what did you agree to.
I suggest that you should seek for Free Legal Advice from the Malaysian Family Court.
You are pretty confused.
An uncontested divorce is “quick”.
Ask for free legal advice from the Malaysian law society.
The family court in Malaysia should give you a schedule of where to seek for it.
Thanks for your advice.
Whatever did in Malaysia is no way to turn back, i just want to find out a way to settle the hdb problem. Even if i have court order stated that the flat belong to me, HDB in singapore will not accept it. No way and no point to do anything in Malaysia now.
Upon divorce, the flat must be sold and the proceeds to be divided.
How is it divided ? You have to know. You should know. All these should be sorted by your husband’s lawyer.
Since you have no representation, you have to inquire from your husband’s lawyer.
The court in Malaysia will decide.
The court does not decide who is the owner.
You cannot be the sole owner even though you have custody of the child.
You have to understand what you can or cannot do.
HDB cannot advise you what you can do or what you cannot do.
You have to seek legal advice. Some law firms do not charge for first interview. Some do.
It seems to me that you intend to need your husband to transfer his share of the house to you. (see above)
I suggest that you find out from your husband’s lawyer.
have you ever contributed to the payment of the HDB flat?
The Malaysian court has no jurisdiction over HDB. hDB is govt owned.
Hdb cannot decide the division of asset. The court does, the court has to also abide byvthe rules of HDB and CPF if applicable.. And it's not always true that you must sell off the property. some do get tranfered , refer to below post. The only potential problem is your ex may want to contest the transfer.
Find out from HDB what kind of documents you need to complete the process. ifbyou need to then
go talk to a Singapore lawyer and file for Singapore court action to deal with your HDB matrimonial asset.
Foreign decree of divorce is recgonised in Singapore court of law.
From http://www.hdb.gov.sg/fi10/fi10326p.nsf/w/ChgOwnerDivorce?OpenDocument
Under the HDB's prevailing policy for divorce (not due to non-consummation of marriage or annulment or break-up of Fiancé / Fiancée relationship), a divorced party who has the custody of the child (including care and control) is allowed to retain the flat subject to the eligibility conditions.
If there are no children from the marriage, the divorced party (flat owner) may retain the flat under the Single Singapore Citizen (SSC) Scheme, provided:he / she is a Singapore citizenhe / she is at least 35 years oldthe matrimonial flat must be a resale flat purchased from the open market without the CPF Housing Grant for Family.
If the matrimonial flat is bought directly from HDB (including resale flats bought with the CPF Housing Grant for Family), the 5-year minimum occupation period (MOP) must be satisfied before the divorced party is allowed to take over the flat under the SSC Scheme.
Alternatively, the divorced party may include another person to retain the flat, subject to the prevailing eligibility criteria and eligibility scheme regardless of the occupation period.
If the divorced owners wish to resell their flat in the open market, they must have completed the MOP for the flat, as at the date of divorce completion. If the divorce is within the MOP and none of the owners is eligible to retain the flat, the owners may have to return the flat to HDB, subject to HDB's approval. The compensation for the return of flat will be determined by HDB.

Smarter than what you've posted so far. If you don't know, say you don't know. Don't send her on a wild goose chase.
You are just trying to reclaim your credibility as a one who knows all but is actually an empty vessel.
"Empty vessels makes the most noise"

"Empty vessels makes the most noise"
Tsk tsk tsk. Some fragile ego you have. Empty vessel is better than giving out wrong info but still want to act smart and don't want to admit you don't know.
It is already stressful for her to go through her current situation, you still want to give her wrong direction to make her life harder!
ä¸会就ä¸è¦乱乱讲, 帮ä¸了 ä½ å儿害了她!
The official website already clearly stated under the procedure "
To determine if you are eligible to retain the flat arising from a change in family structure, please approach the HDB Branchmanaging your flat."
What "credibility" are you refering to?
The rules are set by hdb, not me. I told her to go see hdb from my first reply. You are the one who jumped to conclusion and spout nonsense.
The only person here who has lost credibility is you, not me.
I forgot say THANK YOU for your comment to me as a "CHARLATAN".
I am impress by it.

You are most welcome.
That's the best word to describe you for now. Glad you appreciate it.
