Hawker fined S$10,000 for slicing off victim's thumb

SINGAPORE: A hawker who sliced off a victim's thumb during an
argument last year has been sentenced to one day's jail and fined
S$10,000.
A district court convicted Sim Yong Ha of hurting 57-year-old Chan Seng Chai on September 30 last year.
An argument had broken out between the two men over a bowl of fishball noodles.
Chan grabbed a plastic chair and charged at Sim.
To protect himself, Sim took a chopper from inside his stall and used it to block the chair.
But the chopper hit Chan's hand and sliced off his thumb.
Before sentencing, District Judge Ronald Gwee said this was an
"exception case" and had some words for the victim who, he said, was
clearly the aggressor.
The judge said the victim was younger of the two and was of bigger build.
He said Sim feared for his safety and so used the chopper.
Chan's thumb has since been re-attached.
MediaCorp understands that he was not arrested for his role in the fight.

Though the Penal Codes has a section about self defence, but it is never applied.
So if someone charges to you with a stick or knife, all you can do is stand there and let the aggressor beat you into a pulp or hack you to pieces.

Sometimes running don't work, you need to confront the attacker.
If the aggressor has a knife, a person running away will have his back exposed for the attacker to stab.
ya he shd have thrown all his fishballs at the aggressor lol. see he scared or not.

you are very right. of all posts made in SC, this one's one of the best. also sg law should be modified for foreign labors FTS, but see now FTs committing crime still can live off our taxpayers' paid black bean rice in jail.

Singnapore harder to fight a case of self defense. Lastime china gt self defense case not guilty, the lawyers in Singapore say if happen in Singapore might get jailed.

Objective test on a subjective mind ma. So it will really also depend on the facts.

if someone had attacked a minister that way, and the defender whips out a stick from somewhere in self defence. In the process, the aggressor's head suffered a crack in the skull, would the minister have been jailed for a day?
I don't think so but me feels ministers are more and more liable for attacks with each passing day.

huh! not morning meh....oops sori, just woke up, sky look so dark like in the morning..what a cool day...to sharpen chopper
i just remove my sword from the scabbard and putting some oil lubricant and clean the blade, esp at the tip. just in case need to duel with you again during saturday its functioning.

Objection!!! i did it for self protection, how can one stop a prick other than chopping it off in self defenses, as a victim of an aggressor, I shall appeal to this silly verdict!!!

Final verdict, to prevent such incident from happening, use fixed stool chair instead of removable plastic chair.

Judge: Well my little ignorant friend, this is the land of laws. We cannot allow any Tom Dick and Harry to take matters into thier own hands! Were u in immediate bodily harm or life threatening ? Did u HAVE to chop the poor man's dick off ? I dont see no proportionality here! I do not see it as a neccesity either. The option of retreat was clearly available for u.
All i see.. is an angry citizen, bent on taking the laws into her own hands! Resulting in exccesive force in rendering the man's dick severed.
Your belief of imminent danger is unwarranted. Traditionally, the imminence of danger has been held to be a question of fact and degree and not a requirement of law. Nevertheless, in deciding whether your self-defence is legitimate, the issue of imminence may not be ignored by must be weighted together with the seriousness of the threat and opportunity to seek protection without resorting to the use of force.
So I must end this debacle by making it clear, that you must see yousself as being in "real" or crystalised danger, and not merely think that there may be some future danger to you.
Appeal Dismissed !
