6 On Mr Shanmugam's concern over the application of section 377, let me assure the Member that AGC has been clear and consistent in its approach when prosecuting offenders under this section. We prosecute persons under section 377 where oral sex is performed with a minor under 16 years of age, or where the act is carried out in public, involved deception, coercion or which amounted to sexual assault. We also prosecute persons who have taken advantage of the mentally deficient, or who abuse their positions of trust, dominance or authority to sexually abuse and exploit those who are in their care. I have gone through the facts of recent cases. The cases prosecuted bear this out. In some of them, multiple factors were present.
7 No man or woman engaging in consensual oral sex in private even though, strictly speaking, coming within the ambit of section 377, has been prosecuted for many years now. This was clarified by my Ministry in an earlier case involving a Police officer and an under-aged girl. In this and the other recent cases that were prosecuted in Court, there were one or more of the aggravating factors that I had mentioned earlier.
8 Section 377 is framed in wide terms. Yet, AGC only prosecutes certain cases. Is this a haphazard approach that is undesirable? Under Article 35(8) of our Constitution, the Attorney-General who is also the Public Prosecutor, is vested with the discretion to institute, conduct or discontinue any proceedings for any offence. The Privy Council held in Teh Cheng Poh vs PP, an appeal from Malaysia, hence of persuasive authority, that there are many factors which a prosecution authority may properly take into account in exercising its discretion whether to charge a person at all. The PP takes into account all the relevant factors of an individual case before taking a decision to charge a person. Basically, our Constitution requires all cases to be given unbiased consideration by the PP, and that the decision made not be dictated by irrelevant considerations. The primary consideration is whether it is in the public interest to prosecute the offender. Even if the victim purportedly gives consent, the public interest in such prosecution is to protect those who are vulnerable - whether from tender age, mental deficiency or arising from a position of trust and dominance. This scope of coverage is borne out by provisions on sexual offences found in the other provisions of the Penal Code, Children and Young Persons Act and the Women's Charter. Hence, the way s 377 has been applied does not breach the rule of law. These considerations are also relevant and taken into account in prosecution of such cases in other jurisdictions (US, UK).
9 Dr Wang, Mr Shanmugam, Mr Chong and Mdm Ho have specifically asked that section 377 be reviewed. Indeed, we are doing just that. We are considering decriminalising consensual oral sex done in private between a male and female above 16 years old. We will study the most appropriate approach to effect changes to this aspect of the law, which will also ensure that non-consensual oral sex remains an offence.

The Joint Singles Scheme allows two to four single citizens to jointly buy an HDB flat from the open market. If you wish to buy a resale flat under the Joint Singles Scheme, you and the co-applicant(s) must meet the following eligibility conditions:
Citizenship
You must be Singapore Citizens.
Age
You must be at least 35 years of age (based on date of birth) at the point of submission of your resale flat application. This age criterion applies to both unmarried singles and divorcees.
As for widowed persons and orphans, the age criterion is at least 21. The orphan buying the resale flat must not have another sibling below the age of 35 buying a flat separately under the Orphans Scheme, SSC or Joint Singles Scheme.
Special Condition
You must buy the flat jointly as co-applicants.
Income Ceiling
There is no income ceiling (unless applying for CPF Housing Grant and/or an HDB loan).
Ownership of Private Residential Property
You can own private property (unless applying for CPF Housing Grant) but must live in the HDB resale flat.
